Rabio Search Enhancer will start bringing you advertising that’s relevant to your interests right away – and you can change your mind as often as you like! Rabio is an online advertising software and services company whose mission is to give users more control over their online experience. The “Search Enhancer” is a software program that allows users to express and manage online advertising preferences.

Here is Rabio’s End User License Agreement

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS BEFORE DOWNLOADING, INSTALLING AND USING THE RABIO Search Enhancer (THE "SOFTWARE") PROVIDED BY RABIO CORPORATION ("RABIO"). USE OF THE SOFTWARE IS SUBJECT TO THE TERMS AND CONDITIONS SET FORTH IN THIS LICENSE AGREEMENT. BY INSTALLING THE SOFTWARE YOU INDICATE YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET FORTH HEREIN. RABIO RESERVES THE RIGHT TO REVISE THIS LICENSE AGREEMENT AND PRIVACY STATEMENT AT ANY TIME.

PLEASE READ THIS LICENSE CAREFULLY AS IT IS AN AGREEMENT. WHEN YOU CLICK "ACCEPT" OR ANY ACKNOWLEDGMENT BELOW, OR BY USING ALL OR ANY PORTION OF THE SOFTWARE (DEFINED BELOW), YOU:

  1. ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT
  2. AGREE THAT THIS AGREEMENT IS ENFORCEABLE LIKE ANY WRITTEN NEGOTIATED AGREEMENT SIGNED BY YOU.

IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.

Functionality

The Software gives you more control over online advertising, paid search listings, offers and links, without pop-ups. The Software starts automatically when you start your computer and advertising results are generated based not only on the terms you type into search engines, but the advertising category preferences Rabio’s “Search Enhancer” allows you to select and manage. All done without the collection of any personally identifiable information; your privacy is always protected.

The Software is a browser function plug-in that creates an advertising preference file for each user that can be managed only by that user. The global user identifier (GUID) unique to each software download is used to match the user to his or her preference page, resident at www.rabio.com.

When a user is searching for a Web site that cannot be found or may not exist, the Software may direct your Web browser to content from among our sponsors’ Web sites within the context of the Web site address, or URL, you entered in combination with your stated preferences.

The Software can also direct your Web browser to additional Web sites based on the context of a Web site address, or URL, you entered.

Agreement modifications

Over time, Rabio may evolve or increase the technical functionality of the Software, which will further enhance the ability of users to control this functionality. You hereby consent to any and all increased technical functionality for the purposes set out in this Agreement.

Rabio may also modify other elements of this agreement from time-to-time. All changes will be posted at www.rabio.com. Your continued use of the Software subsequent to the posting of any changes will constitute your assent to the modified agreement.

Managing access to adult content

Please note that the only time you will receive Adult-oriented ads is if you utilize keywords connected to, search for or view Adult Web sites. Content that is “Adult” is defined as any audio, video, audiovisual, images, sounds or text that contain or reference any of the following: profanity, crude or off-color humor, violence, blood and gore, weapons, use of alcohol, drugs, tobacco or other controlled substances, online gambling, pornography, erotica, erotic images, nudity, sex, sexually explicit images, and sexual references.

If you are using Microsoft Internet Explorer, you can utilize its “Content Advisor” feature to restrict certain types of sites and advertisements, including Adult sites, from opening in your browser.

Specifically, please follow the following steps:

  1. In Internet Explorer, select Tools/Internet Options
  2. Select the Content tab
  3. Select either Enable to turn on this feature and adjust the settings or Settings (if the feature is already enabled) to adjust your settings
  4. Customize your settings under each of the available tabs.

Uninstallation

You understand and agree that the presence of the Software on your computer is voluntary and that you may remove the Software from your computer at any time.

The Software may be easily uninstalled by going to the "Add/Remove Programs" menu on your computer and clicking the "Remove" button next to the entry for the Software. Specifically, to uninstall the Software, please follow these steps:

  1. Close all browser windows
  2. Go to Start menu
  3. Select "Control Panel"
  4. Select "Add or Remove Programs"
  5. Select “Rabio”
  6. Click "Change/Remove"

Please note that if all browser windows are not closed, one file (C:\ProgramFiles\RCSE\RCSE.dll) cannot be deleted, though it may be removed later.

The License

As long as you comply with the terms of this Agreement, Rabio grants to you a non-exclusive, revocable license to use the Software, in binary executable form only, solely for the purposes described in this Agreement

The Software is licensed to you for your personal, non-commercial use only. Other than the rights expressly granted hereunder, no other right is granted to you. Without limitation, you may not: (a) modify or create any derivative works of the Software or documentation; (b) decompile, disassemble, reverse engineer or otherwise attempt to derive the source code for the Software; or (c) redistribute, sublicense, or otherwise transfer rights to the Software.

Rabio reserves the right to periodically update and/or upgrade the Software at Rabio's discretion. Your installation of the Software indicates your acceptance of potential future updates and/or upgrades to the Software.

The Software is the intellectual property of, and owned by, Rabio and its licensors and suppliers. The structure, organization and code of the Software are trade secrets and confidential information of Rabio and its licensors and suppliers. The Software is protected by copyright, without limitation by United States copyright law, international treaty provisions and applicable laws in the country in which it is being used. Except as expressly stated herein, this Agreement does not grant you any intellectual property rights in the Software, and all rights not expressly granted are reserved by Rabio and its licensors and suppliers

As a condition of this license, you will:

  1. Comply with all applicable laws, including U.S. export control laws, during your use of the licensed Software.
  2. Only use the licensed Software for personal, non-commercial use.

And you will not:

  1. Reverse engineer, disassemble or decompile the Licensed Software or attempt to discover or recreate the source code to the Licensed Software, except as otherwise required by applicable law.
  2. Make any modification, adaptation, improvement, enhancement, translation or derivative work of or to the Licensed Software.
  3. Remove, alter or obscure any proprietary notices (including copyright notices) of Rabio or its licensors in the Licensed Software.
  4. Use the licensed Software for purposes for which it is not designed.

Age / Language Limitation - all users bound

Rabio products and services are not available to individuals below the age of 18. By accepting this installation, you are representing that you are not a minor below the age of 18.

You must be an English speaker or have enlisted the aid of a person able to properly translate this document into a language in which you are fluent to use the licensed Software.

You represent and warrant either that you have authorized the download and installation of the Software, or that the owner of the computer has authorized you to do so.

You agree, with respect to all users of the computer on which you have caused the Software to reside, to provide a copy of these terms and conditions and to obtain their consent to these terms and conditions before allowing them to use the Software. Alternatively, if you have the legal right to accept this agreement on behalf of one or more users of the computer on which you have caused or authorized the Software to reside, then you hereby accept this Agreement on behalf of all such other users. You understand that the presence of the software on any computer is voluntary and that you may remove it at any time

DISCLAIMER OF WARRANTY

YOU EXPRESSLY AGREE THAT THE USE OF THIS SOFTWARE IS AT YOUR OWN RISK. THE SOFTWARE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES THAT IT IS FREE OF DEFECTS AND ERRORS, FIT FOR A PARTICULAR PURPOSE, OR NON-INFRINGING. RABIO RESERVES THE RIGHT TO PERIODICALLY UPDATE AND/OR UPGRADE THE SOFTWARE AT THE COMPANY'S DISCRETION. YOUR INSTALLATION OF THE SOFTWARE INDICATES YOUR ACCEPTANCE OF POTENTIAL FUTURE UPDATES AND/OR UPGRADES TO THE SOFTWARE.

THE INFORMATION AND SERVICES PROVIDED BY THE SOFTWARE AND/OR RABIO ARE SIMILARLY PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND. THE ACCURACY AND RELIABILITY OF ANY INFORMATION OR SERVICES PROVIDED BY THE SOFTWARE AND/OR RABIO SHOULD BE INDEPENDENTLY VERIFIED BY YOU PRIOR TO MAKING ANY DECISIONS BASED ON SUCH INFORMATION OR SERVICES.

Compatibility

Rabio does not warrant that the Software will be compatible with your hardware or other software installed on your computer system. Compatibility issues may cause your computer's performance to suffer. In the event that the Software is not compatible with your hardware or other software installed on your computer system, the Software can be uninstalled by going to the "Add/Remove Programs" menu on your computer and clicking the "Remove" button next to the entries for Rabio. (Please refer to “Un-Installation” above for detailed uninstall directions). Like all software, the Software utilizes some of your computer's resources to run, including system memory and Internet connection. Use of the Software on a computer with inadequate system resources will cause such computer's performance to suffer.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL RABIO OR ITS AGENTS BE LIABLE FOR ANY DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES TO USERS' SYSTEMS AND/OR SOFTWARE AND/OR DATA, COMPUTER FAILURE OR MALFUNCTION, COMPUTER VIRUS TRANSMISSION, PERFORMANCE DELAYS OR COMMUNICATION FAILURES, SECURITY BREACHES OR ANY AND ALL OTHER DAMAGES OR LOSSES.

EVEN IF RABIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL RABIO'S ENTIRE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT EXCEED $5.00 US.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Governing Law

This License Agreement is governed by, and shall be construed in accordance with, the laws of the State of Connecticut, without regard to its conflicts of laws rules.

Privacy Statement

By downloading the Software, you give permission to Rabio to display relevant and context-driven information and offers. The Software selects which ads and offers to show you based on several factors, including the current URL and individual user preferences.

To protect your privacy, the Software uploads a database of content in small chunks to your computer and then determines on your computer whether to retrieve information from Rabio or third-party servers. To protect your privacy, the same database of content is sent to all computers. Decisions regarding which ads to deliver to an individual computer are all processed on the individual user's computer - and isolated from Rabio servers. In this way, Rabio is able to deliver to you relevant information and advertisements without sending all of your browsing activity back to Rabio and without establishing any profile about you (even anonymously) on Rabio servers.

Your privacy is also protected in the following manner:

  1. Your personally-identifiable information is not required in order to use the software. Rabio, does not know your individual identity and does not attempt to discern it in any way.
  2. As you surf the Internet, your "clickstream data" (i.e., a log of all the sites you visit) is not transmitted to Rabio or any third party server.
  3. Rabio does not assemble any personally-identifiable browsing profiles of you or your computer.
  4. Rabio does not assemble any anonymous computer identifiable browsing profile of you or your computer.
  5. Rabio does not track which ads and offers you see as an individual user. All of our analysis and tracking of ads is done in the aggregate.

The Software does send a limited amount of information from your computer in order to count the number of users in our network, and optimize the performance and relevance of the ads. Rabio has intentionally designed these communications back to Rabio to be highly protective of user privacy, in the following way: each individual computer is assigned an anonymous, unique computer ID. This computer ID is used only to enable Rabio to count unique, active computers in the network. The computer ID is not used to determine which ads serve individual users or to create browsing profiles of users.

The Software does not place any cookies on your computer. It is possible that a third party advertising on our network might place a cookie on your computer. If you wish to opt-out from third party cookies, please click on the following link and follow the instructions (if available): http://www.networkadvertising.org/optout_nonppii.asp.

Certain text links provided to you through the Software represent paid listings provided by third-party partners. Clicking on these links will subject you to the privacy policies of such third-party partners, which may be different than the terms described in this Privacy Policy. Certain usage statistics may be collected by such third-party partners for the purpose of detecting fraud and otherwise monitoring the integrity and performance of their product or service.

Export

You agree that the Software may not be acquired, shipped, transported, exported, or re-exported (1) Into (or to a national or resident of) any U.S. embargoed country or (2) To anyone on the U.S. Treasury Department's list of Specially Designated Nationals, or the U.S. Department of Commerce's Table of Denial Orders. By using the Licensed Software, you represent and warrant that you are not located in, under control of, or a national or resident of any such country or on any such list.
